These Terms of Service ("Terms") govern your use of the Horizon Immigration Consultants website and the engagement of our immigration consulting services. By accessing our website or engaging our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the website at horizonimmigration.com.au or by engaging Horizon Immigration Consultants ("Horizon", "we", "us", "our") for consulting services, you confirm that you have read, understood and agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree to these Terms, you must not use our website or engage our services. These Terms apply to all visitors, users, clients and others who access or use our services.

2. Our Services

Horizon Immigration Consultants provides immigration consulting services including, but not limited to:

  • Visa eligibility assessments and migration advice
  • Preparation, review and lodgement of visa applications
  • Skills assessment guidance and coordination
  • Employer sponsorship and nomination support
  • Family migration advice and application assistance
  • Strategic migration pathway planning
  • Document preparation, translation coordination and submission

The scope of services in any individual engagement will be set out in a written Service Agreement or Client Engagement Letter provided prior to commencement of work.

3. Not Legal Advice — Important Disclaimer

Important: The information provided on our website is general in nature and does not constitute legal advice. Immigration law is complex and changes frequently. Horizon Immigration Consultants provides immigration consulting services, not legal representation. Nothing on this website creates a solicitor-client relationship.

Outcomes of visa applications depend on individual circumstances, the accuracy and completeness of information provided, and decisions made by the relevant immigration authorities. We cannot and do not guarantee the outcome of any visa application.

You should seek independent legal advice if you have concerns about your specific circumstances.

4. Client Obligations

By engaging our services, you agree to:

  • Provide accurate, complete and truthful information at all times
  • Notify us immediately of any change in your circumstances that may affect your visa application
  • Provide all requested documents in a timely manner
  • Not misrepresent or withhold any information relevant to your immigration matter
  • Review all documents prepared on your behalf before lodgement and confirm their accuracy
  • Pay all agreed fees promptly and in accordance with the payment schedule
  • Comply with all visa conditions if your application is granted

You acknowledge that providing false or misleading information to immigration authorities is a serious offence and may result in visa refusal, cancellation and/or legal consequences. Horizon Immigration Consultants accepts no liability for consequences arising from inaccurate information provided by the client.

5. Fees & Payment

Our professional fees are agreed upon and set out in the Service Agreement provided to you before we commence work. Unless otherwise stated:

  • Fees are quoted in Indian Rupees (INR) or the agreed currency
  • Government visa application charges, skills assessment fees and third-party costs are not included in our professional fees and are the client's responsibility
  • An initial consultation fee or retainer may be required prior to commencement of services
  • Invoices are payable within 7 days of issue unless otherwise agreed in writing
  • We reserve the right to suspend or cease services where fees remain unpaid

6. Refunds & Cancellation

Refund eligibility depends on the stage at which services are terminated:

  • If you cancel before any work has commenced, a full refund of any retainer paid will be provided, less any out-of-pocket expenses already incurred
  • If work has commenced, fees for work already completed are non-refundable
  • If your visa application is refused by the relevant authority, this does not entitle you to a refund of our professional fees, as our fees relate to the professional services rendered, not the outcome
  • Government fees and third-party charges paid on your behalf are not refundable by Horizon and are subject to the refund policies of the respective authority

All refund requests must be made in writing. Refunds, where applicable, will be processed within 14 business days.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Horizon Immigration Consultants shall not be liable for any indirect, incidental, consequential, special or punitive damages arising from or relating to our services or your reliance on information provided on our website
  • Our total aggregate liability to you shall not exceed the total fees paid by you to us in the 12 months preceding the event giving rise to the claim
  • We are not liable for delays or decisions made by immigration authorities, changes in immigration law, or government processing times
  • We are not responsible for consequences arising from inaccurate or incomplete information provided by you or any third party

Nothing in these Terms limits liability for fraud, wilful misconduct, or any liability that cannot be excluded by law.

8. Intellectual Property

All content on this website — including text, images, graphics, logos, design elements and software — is the property of Horizon Immigration Consultants or its content licensors and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, publish, display, perform, modify, create derivative works from, or in any way exploit any of the content of this website without our prior written consent, except for personal, non-commercial use.

9. Website Use

You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

  • Use the website in any way that is unlawful, fraudulent or harmful
  • Transmit any unsolicited or unauthorised advertising material
  • Knowingly transmit viruses, malware or other technologically harmful material
  • Attempt to gain unauthorised access to any part of the website or its infrastructure

11. Termination of Engagement

Either party may terminate the consulting engagement by providing written notice. Horizon reserves the right to terminate the engagement immediately if:

  • You provide false, misleading or fraudulent information
  • You fail to pay agreed fees by the due date after a reasonable notice period
  • Continuing the engagement would require us to act in breach of our professional obligations or applicable law
  • Your conduct towards our staff is abusive, threatening or unreasonable

Upon termination, you remain liable for fees for services already rendered up to the date of termination.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or our services shall first be referred to good-faith negotiation between the parties.

If a dispute cannot be resolved through negotiation within 30 days, the parties agree to submit the dispute to mediation before commencing formal legal proceedings. The courts of Chandigarh, India, shall have jurisdiction over any unresolved disputes.

13. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of significant changes by posting the updated Terms on this page with a new effective date. Your continued use of our website or services after such changes constitutes your acceptance of the revised Terms.
